JOHOR BARU: A senior citizen accused of slapping a man for eating in public during Ramadan has been discharged without being acquitted by the Magistrate’s Court.
Magistrate A Shaarmini granted a discharge not amounting to an acquittal (DNAA) to Abdul Razak Ismail, 65, after the Attorney General’s Chambers (AGC) instructed that the case be referred back to them.
The ruling was made while the court was setting bail conditions for the accused.

Accused Disputes Prosecution’s Account
Earlier, Abdul Razak had pleaded guilty to a charge under Section 323 of the Penal Code but later disputed the case’s facts, leading the magistrate to reject his plea.
The alleged incident took place at a convenience store in a shopping mall on Sunday (March 16), with the victim claiming he was slapped twice.
Following the circulation of two viral videos, the police confirmed that the victim had filed a report, and investigations continue under Section 323 of the Penal Code.
